Kathryn Walters, prosecuting, said police took Richard Faku to Foss Park Psychiatric Hospital out of concern for his mental health.
Doctors there examined him and told him he did not need hospital treatment and that he was mentally competent enough to cope outside of the hospital.
“He went into the parking lot, pulled down his pants and defecated in front of all the cars in the parking lot,” Walters said.
Richard Faku, 61, of Horseman Avenue, off Cemetery Road, York, pleaded guilty to public order offenses.
The judges told him: “It would have been extremely unpleasant for hospital staff and visitors to see you doing that and they should have cleaned it up. ” he said.
They said this was an “extremely rare” case. He argued his sentence should be reduced as he pleaded guilty, was given a 12-month conditional release and ordered to pay a statutory surcharge of £26 and prosecution costs of £85.
Abi Whelan said she has had mental health issues for several years and continues to have them. He had no memory of what he had done.
He really needed the treatment of a neurologist, not a psychiatrist.
He had recently undergone a brain scan that revealed “abnormalities” and was awaiting an appointment to discuss his future course of action.
