The witness and another man were with Fahim Khan and 20-year-old Zaid Zahir on August 28th last year, where Khan and Zahir allegedly raped the same girl early on August 28th last year. We were with them.

He claimed he heard the victim say “I don't want to” and “I'm too drunk” and then he said he would move out of the bushes.
He said Khan and the girl had crossed the wall for five to ten minutes.
The man denied that they had consensual sex at the time.
“It was rape,” he said.
He said at the time that he “just frozen” and did nothing to help the victims suspected.

The man went to pick up his bike next to the bridge and caught up with others near North Street Garden about 20 minutes later.

The man said he was told after he arrived that Zahil was engaged in sexual acts allegedly victimized.
He claimed that Zahir asked him: “Are you going to do something with (a alleged victim)?”
“I'm not interested in that at all,” the man said. “She was very drunk.”
The trial at York Crown Court continues.
